What happens if the sale doesn’t close?
If your sale doesn’t close for any reason, you can either substitute another listing that is under contract or any of your next listings or another transaction that is set to close in the future. We do not recommend that you enter into a commission advance agreement with any company that requires you to repurchase your advance if after a certain period of time you do not close any of your listings. The typical Commission Advance agreement that our competitors will ask you to sign is called a “Master Purchase, Security and Repurchase Agreement”. The repurchase agreement that you will be required to sign states that when your transaction fails to close, and none of your proposed replacement transactions close within a certain period of time (usually 6 months), you will be required to repurchase, out of pocket and not with future commissions, the amount that was advanced to you, together with any advance fees. A Commission Advance by Commission Assist does not have any repurchase clause. We only secure our advance with future real estate commissions, not personal funds.
